Computing, transfer, data calls at cost + 10%, and a $0.01 run fee. - Creator’s price: set by the creator, $0 to $5, charged only when the run worked. Before a run starts, Modpack sets aside the most it can cost, and Claude shows it. Each pack’s typical run as listed today. A bigger job costs more, and your per-run limit caps any single run. ## Limits you control - **Per-run limit** (default · up to $10): $2. A run that would cost more doesn’t start, and Claude tells you why. - **Monthly limit** (default · up to $500): $50. New runs wait until the 1st, or until you raise it. Running ones finish. - **Low balance** (never a failed run): Waits. The run waits up to 24 hours and starts by itself when your top-up lands. - **Auto top-up** (opt-in): Off. Offered after your first purchase: add $10 when you’re below $2, up to a monthly cap you pick. ## You don’t pay for runs that don’t work - **It worked**: Usage plus the creator’s price, exactly as on the receipt. - **It didn’t work**: Nothing: crashes, time-outs, results that fail the pack’s checks, and problems on our side. The reserved amount goes back at once. - **You stopped it**: What it used until you stopped it. Never the creator’s price. - **It’s waiting for funds**: Nothing until it starts. If you don’t top up within 24 hours, it’s cancelled. - **You think a charge is wrong**: Press “Report a problem with this charge” on the receipt. If the run didn’t do what it said, we refund it. ## Paying: a prepaid balance you top up when you want - **Top-ups** ($10 · $25 · $50): Cards only: Apple Pay, Google Pay, Link or a card. Sales tax is added at checkout where it applies. - **Paid credit** (Never expires): No monthly fee. When you close your account, what’s left is refunded to your card. - **Promotional credit** (Spent first): The $5 starter credit and invite rewards. No cash value; each shows its expiry date. ## Questions ### Does my Claude plan cost extra? Modpack is separate from your Claude plan. It works on Claude Free, which allows one custom connector, and on every paid plan. ### What if a creator changes their price? An increase applies 14 days after it’s announced, and Claude shows the new price before your next run. A decrease applies right away. ### Can I buy for my business? Yes. Tick “Buying for a business” when you top up to put your company name and tax ID on receipts. ### Who gets the creator’s price? The creator keeps 80% (90% for founding creators). (once · about 60 s) 2. **Ask in your own words**: Claude picks the pack and shows the most the run can cost before it starts. (any Claude app) 3. **Get the result in the chat**: Every finding, table and file comes back to Claude. Say “fix these” and keep going. (no page to open) 4. **Pay only when it works**: Per run, at the price shown before it starts. A run that doesn’t work costs nothing. ($5 free to start) ## What happens when you ask 1. **Ask Claude** (You): In any chat, in your own words. 2. **Claude sends the request** (Your AI): The pack’s name and this run’s inputs. Nothing else from your chats. 3. **Runs and checks it** (Modpack): In a fresh sandbox with the pack’s tools and data, then checks the result. 4. **The complete result** (Back in Claude): Findings, tables and files as attachments Claude can read and act on. Your Claude does the talking. Modpack does the running. ## When Claude sends you a link Only for what your agent can’t do for you. Everything else stays in the chat, including short text files up to 64 KB. Each link opens one page and takes you back to Claude. - **Sign in once** (first time only): Claude can’t sign you in. One Modpack page, then you’re back in the chat. - **Approve new access** (your private data, or a new creator’s pack from a link): Your agent can’t approve its own access. One button. For other packs, Claude tells you the price and asks in the chat. - **Top up or raise a limit** (when a run needs it): Payments need you, not your agent. The waiting run starts by itself. - **Connect another account** (Instagram, Google): Instagram and Google only let you grant access to your accounts. ## What the labels on a pack mean Each label is earned by something that happened, and dated. Nobody can buy or edit them. - **Rebuilt from scratch**: Modpack rebuilt the pack from its own files in a clean sandbox, and it ran. Every version, automatically. - **Checks passed**: Secrets, malware, where it connects, the safety of its instructions, and a trial run by a test agent. Every version, in about 2 minutes. - **Tested on cases**: It gave correct results on test cases, including tricky ones the creator didn’t write. Every version that changes how it works. - **Used again by people**: People who ran it came back and ran it again within 30 days. Needs 5 or more people. - **Confirmed by people**: People marked its results as right. Needs 5 or more people. A success rate shows only after 20 runs from at least 3 people in 30 days. New creators’ packs say “New creator · automated checks” until they’ve been around 14 days and 5 people have checked results. ## Updates: anything that asks for more waits for you You follow updates by default: each version passes its checks and tests first and says what changed. To pin a version or try early ones, open the pack in Your packs. Modpack keeps a receipt and a record of each run, if you want them. ### Does Modpack see my other chats? Every run gets a fresh sandbox of its own. Creators never see your inputs or results, and you can take everything with you, anytime. ## Where packs run: your computer stays out of it 1. **You ask Claude** (your device): On the web, desktop, phone or in Claude Code. Pack code never runs here. 2. **Your connection** (mcp.modpack.egoeimi.org): Checks who you are, which packs you added, and your limits. 3. **A fresh sandbox** (per run): Only this run’s inputs, no secrets. Deleted after the run. 4. **Only declared hosts** (egress proxy): It reaches only the sites the pack declared. Every connection is logged. - **Results come back as data**: Claude gets the complete result in a fixed format. Hidden text, links to run and remote images are stripped out. - **Files come back as attachments**: Claude can read them and you can save them. Which pack, the mode, and what it needs, like a site address. - Sent: **Files you give it**. Only for this run: short text up to 64 KB through the chat, recordings and bigger files through our upload page. - Not sent: **Never your other chats or memory**. Modpack never asks Claude for them, and packs can’t either. - Not sent: **Never your other connectors’ data**. A pack that tries to make Claude read another connector is held by our checks. Per pack. Remove a pack anytime. 2. **Access your private run data**: Your inputs, results and files: only you, and your own agent through your connection. Always yours. Nobody else gets this. 3. **Contribute learning from your runs**: Packs learn from de-identified patterns, like “this site blocks crawlers”, never your inputs or results. Required for managed use. Withdrawing pauses your packs; export still works. 4. **Receive updates**: Follow updates, pin a version, or try early versions. Per pack. Anything that asks for more waits for you. We don’t sell your data or use it to train AI models. License - **Pass, hold or block**: Most versions pass in about 2 minutes. A held version works only for its creator until it’s fixed or a person decides. - **Paused in minutes**: If something goes wrong after publishing, we pause that version, move everyone back to the last good one, and tell you. Past results don’t change. ## Report a problem - **A pack**: Use Report on the pack’s page. New adds of that version pause while we look; people who added it keep working. The connection you added in Claude is already here. Type `/mcp` to see it. **Signed in with an API key** (one command): run this once. It adds Modpack to every project, then opens the browser so you can sign in. Until it’s ready, use Claude or Claude Code. ## On your phone (iPhone, Android) Add Modpack once on claude.ai, from a computer or your phone’s browser. It appears in the Claude app the next time you open it. When Claude needs you to sign in, approve or top up, it gives you a link that opens Modpack and brings you back. Note: Adding connectors from the phone is in beta at Anthropic. If Modpack doesn’t stay connected, add it on claude.ai once. ## Troubleshooting ### Modpack doesn’t show up in Claude Code Type `/mcp`. If it isn’t listed and you use an API key, run the command above. ### Claude says Modpack needs to reconnect In Claude, open Settings › Connectors › Modpack and press Connect. In Claude Code: `/mcp`, pick Modpack, then Authenticate. ### “You can only add one custom connector” Claude Free allows one. Remove the other custom connector, or use a paid plan. ### There’s no Add button on Claude Team Only Owners can add connectors. Paid credit never expires and is refunded if you close your account. - Runs help improve packs through de-identified patterns, never your files, inputs or results. They cover modpack.md, the Modpack connection you add to Claude or another AI agent, and every pack you run, add or publish. “You” means the person who holds the account. A **pack** is a working AI setup that runs on Modpack. A **run** is one use of a pack. A **creator** is someone who publishes a pack. These documents are part of the agreement: the [Privacy notice](https://modpack.egoeimi.org/privacy), the [pricing page and rate card](https://modpack.egoeimi.org/pricing), and, if you publish packs, the [Creator Agreement](https://modpack.egoeimi.org/creators/agreement). Where they overlap, the document written for that topic wins: the Privacy notice for personal data, the Creator Agreement for creator earnings. Modpack is in beta, and some features will change. When a change affects your rights, section 18 says how we tell you. > **Counsel:** Confirm the legal entity name, state of incorporation and notice address. The plan assumes a US company operating from Florida (plan §3.4); a Delaware corporation would also need a Florida certificate of authority. ## 02 · How you agree: one sentence, separate records When you sign in and connect Modpack, this sentence sits beside the **Agree and connect** button: > By continuing you confirm you’re 18+ in the US and agree to the Terms and Privacy Policy. Four permissions stay separate and never imply each other: using a pack, access to your private run data, contributing learning from your runs, and receiving updates. Only you can agree. Claude, Claude Code or any other agent can’t accept, change or withdraw any of these for you. If you publish packs, you accept the Creator Agreement separately, on your own first-time creator page. > **Counsel:** Review the one-sentence clickwrap (plan §9.1, Appendix I): whether one linked sentence beside one button is conspicuous enough for the contribution license and the US and 18+ attestations, and whether the update-authorization and attestation records may point at that sentence (policy document `connect_consent` v1). ## 03 · Who can use Modpack **US residents, 18 or older.** Modpack is open to people who live in the United States and are 18 or older. You confirm both when you connect. We may block sign-ups from outside the US or through anonymizing networks. **One account per person.** Each person gets one account and one starter credit. Extra accounts to collect more credit or referral rewards aren’t allowed. **Using it for work.** You can use Modpack for your own work or for clients. The account is still yours personally, and you confirm you’re allowed to use the material you give packs. **Sanctions.** You can’t use Modpack if you’re on a US sanctions list or act for someone who is. We screen people who pay and people who get paid. **Your sign-in.** You sign in with a passkey, Google, Apple or GitHub. Keep it secure. If someone else used your account, tell us at [security@modpack.md](mailto:security@modpack.md). **Minors.** If we learn an account belongs to someone under 18, we close it and delete its data. > **Counsel:** Confirm whether organizations can hold accounts or accept these terms through an employee. This draft offers personal accounts only, with business use allowed. ## 04 · Packs, and who is responsible for what A pack is a working AI setup: instructions, code and checks that a creator packaged. It runs on Modpack, in a fresh sandbox for each run, not on your computer. **The creator.** Builds the pack, describes what it does, sets its price, and is responsible for its content and for having the rights to it. **Modpack.** Hosts and runs packs, checks every version before anyone else can run it, handles payment, and sells every run. When you pay for a run, you buy it from Modpack, not from the creator. **You.** Choose which packs to run, what to give them, and what to do with their results. **Built by Modpack.** For packs labeled “Built by Modpack”, Modpack is the creator. **Results.** Packs use software and AI models, so results can be incomplete or wrong. Check anything important before you rely on it. A result is information for you, not professional advice. Reports that check sites, such as accessibility sweeps, find only some issues and never certify that a site complies with a law or standard. **What pack pages show.** Evidence with plain labels, never a blanket “verified”. We show a success rate only after at least 20 runs from at least 3 people in 30 days. **Services inside packs.** Some packs call third-party data services or AI models; their cost is on your receipt. A pack that wants one of your own accounts, like Instagram or Google Sheets, always asks you in the browser first, and you can disconnect it anytime. **Your sites and accounts.** Only run packs on sites, accounts and material you own or are allowed to use. A full crawl of a site needs you to verify the domain first. ## 05 · Your agent, and what only you can do You connect Modpack to an AI agent, such as Claude or Claude Code. The agent then acts for you, within the limits you set. **What your agent can do.** Find packs, run the packs you added, read results and files, report a problem and ask for an export. It can also add a listed pack that needs no access to your accounts or files and fits your limits, up to 3 in 24 hours. It tells you in the chat, and you can undo it. Turn this off in Settings with “Let Claude add listed packs by itself”. **What only you can do, in your browser.** Pay or top up, raise limits, approve spend beyond your limits, approve a pack that asks for more access, publish a pack, accept or change these terms and your consents, stop contributing learning, delete your account, and sign legal statements such as a counter-notice. **Runs your agent starts are yours.** Runs your connected agent starts within your limits count as yours and are charged to your balance. Every connected device is listed in [Connections](https://modpack.egoeimi.org/account/connections); revoke one there and it stops working within seconds. **Your AI provider.** Your agent is its maker’s product, under its maker’s terms. Modpack never asks for your AI sign-in, and your agent’s maker isn’t part of this agreement. **Text from packs.** Results reach your agent as data. We strip hidden text, links to run and remote images. Pack text may give you tips, never orders to your agent. We can’t control everything your agent does on your own device. > **Counsel:** Confirm who is responsible for runs a connected agent starts within the person’s limits (draft: the account holder), and the standing authority to add listed, no-access packs without a click (plan Appendix H, capability `deployments:auto_add`). ## 06 · Pay per run, only when it works There’s no subscription and no seats. A run costs what it used plus the creator’s price. Current rates are on the [pricing page](https://modpack.egoeimi.org/pricing). | Line | Price (rate card v1) | | --- | --- | | Computing | $0.005 per vCPU-minute | | Transfer | $0.20 per GB in or out | | Data calls | At cost plus 10%, on its own line | | Run fee | $0.01 per run | | Storage | $0.05 per GB-month, past 5 GB | | Creator’s price | $0 to $5, only on runs that worked | **The most it can cost.** Before a run starts, we set aside the most it can cost, and your agent shows it. You pay what the run used and the rest goes back at once. A run never costs more than what was set aside. **When a run works.** You pay its usage and the creator’s price. **When a run doesn’t work.** You pay nothing, whatever the reason: a problem on our side, an outage at one of our suppliers, or the pack itself. The hold goes back to your balance. **When you stop a run.** You pay for what it used until it stopped. The creator’s price isn’t charged. **Waiting for funds.** If your balance can’t cover a run, the run waits up to 24 hours and starts by itself when you top up. If you don’t, it’s cancelled and nothing is charged. **Receipts.** Every run has a receipt that lists each line. If a charge looks wrong, use “Report a problem with this charge” on the receipt. **Taxes.** Sales tax, where it applies, is added when you top up and shown at checkout. It isn’t added again to runs. **Price changes.** We publish rate card changes at least 14 days before they apply. A creator’s price increase applies 14 days after notice. Runs already set aside keep their price. Decreases apply right away. > **Counsel:** Confirm the published failure policy (“a run that doesn’t work isn’t charged”; plan §8.3 payer table and §19.3) and the 14-day notice for rate card changes, a default the plan leaves open. ## 07 · Balance, credits, top-ups and refunds **Your balance.** Your balance is prepaid credit for Modpack runs. It isn’t a bank account, earns no interest, and can’t be sent to other people or cashed out, except as a refund to the card you paid with. A balance holds up to $2,000, and top-ups are capped at $2,000 a day. **Starter credit.** New accounts get a one-time $5.00 starter credit, one per verified person. It’s promotional, has no cash value, can’t be transferred, and expires 90 days after you get it. It’s spent before paid credit and never turns into a paid charge you didn’t approve. **Other promotional credit.** Referral rewards and the $25 creator authoring credit are promotional too. Each is labeled “Promotional · no cash value · expires \[date\]”. **Top-ups.** $10, $25 or $50, by card, Apple Pay, Google Pay or Link, through Stripe. We never see your full card number. **Paid credit.** Paid credit never expires and has no dormancy or inactivity fees. **Refunds.** If you close your account, we refund unspent paid credit to the card you paid with, within 10 days. If a run was charged by mistake, report it on its receipt and we put the amount back where it came from. A refund never exceeds what you paid. **Auto top-up.** Off unless you turn it on, and offered only after your first purchase. You choose the amount, when it triggers and a monthly cap. You get a receipt every time, and one click turns it off. **Referrals.** When the referral program is on, you can earn promotional credit when someone joins through your link, pays for credit, uses some of it and passes a 30-day hold. Rewards are capped at $300 a year. Referring yourself and bidding on our brand name aren’t allowed, and posts with your link must say you earn credit. **Card disputes.** If you dispute a card charge with your bank, we may pause paid runs on the account until it’s resolved. Your files, results and export keep working. > **Counsel:** Open question 3 in plan §12.7: unused-credit rules, including promotional credit expiry, unclaimed property for paid credit (the Florida §717.1045 reading is medium confidence) and whether any state requires cash refunds of small balances on request. The draft keeps paid credit non-expiring and refundable when the account closes (plan Q-10). ## 08 · Spend limits **Defaults.** $2 per run and $50 per month. Change them in [Limits](https://modpack.egoeimi.org/account/limits), up to $10 per run and $500 per month during the beta. **Reaching a limit.** A run over your per-run limit doesn’t start. At your monthly limit, new paid runs wait until you raise it or the month ends. **What never stops.** Your results, files, receipts and export keep working when your balance is empty or you’re at a limit. **Only you change them.** Your agent can’t raise your limits or approve spend beyond them. ## 09 · Contribution license: runs help improve packs When a pack fails or struggles in a run, Modpack learns from it, fixes the pack, tests the fix and ships it to everyone who uses that pack. That’s how packs get better, and it’s part of using packs on Modpack. **What you license.** You give Modpack a non-exclusive, royalty-free, perpetual and irrevocable license to derive, use, copy, modify and distribute contribution material from your runs, to evaluate, repair and improve packs and Modpack. That includes sharing it with the pack’s creator and building it into pack versions everyone can use. **What counts.** Only de-identified, minimized evidence about how runs go: whether a run worked, error and failure types, timings and resource use, which checks passed, which fix worked, and general patterns, such as a kind of page that blocks crawlers or a library version that broke. **What never counts.** Your files, inputs and results; the text you or your agent send; data from your connected accounts; credentials; raw logs; and anything that identifies you, your clients or another person. Removing a name doesn’t make something eligible. **How it’s de-identified.** Evidence is minimized inside your account before anything reaches another account: fixed fields instead of free text, rounded numbers, synthetic test cases instead of your inputs, and checks that no text from your inputs slips through. Any metric needs at least 5 accounts. Anything unclear is held back and deleted after 7 days. **No re-identification.** Modpack won’t try to re-identify anyone from contribution material. You agree not to re-identify, or help anyone re-identify, any person, account or organization from contribution material, pack metrics or pack versions. Creators agree to the same. **Your right to contribute.** Only run material you’re allowed to use. If an employer or client doesn’t allow even de-identified learning from work on their material, don’t run that work on Modpack. **Ownership.** This is a license, not a transfer. You keep ownership of your inputs and results, and we don’t claim your ideas. **Stopping.** Stop contributing anytime in [Settings](https://modpack.egoeimi.org/account/withdraw). Because learning is part of how managed packs work, stopping pauses your packs: your agent can’t start new runs, queued and waiting runs are cancelled without charge, and a run in progress finishes with its evidence kept private. Export, files, receipts and account controls keep working. Rejoin anytime to resume. **What stopping can’t undo.** Contributions already built into released pack versions stay there. They were never linked to you, and versions people already use can’t be recalled. **Changes to learning.** We won’t use your runs for learning in a materially different way without asking you again first. A new version of this license never applies to runs from before you accepted it. **Not a sale.** We don’t sell contribution material or personal data, and we don’t train AI models on your data. > **Counsel:** Open question 1 in plan §12.7: whether making contribution mandatory for managed runs conflicts with state anti-waiver provisions (for example CCPA §1798.192) if a statute later applies. The draft makes it a condition of managed runs, with a withdrawal that keeps export and every data right. > **Counsel:** Open question 2 in plan §12.7: the precise definition of “non-sensitive”, eligible material. The draft uses a closed list of evidence types and excludes free text, inputs and outputs. ## 10 · Updates to packs you use Packs you add follow updates by default. That’s the update authorization you gave when you connected. Change it per pack on the pack’s page in your account. **Follow updates (default).** A new version that keeps the same permissions, destinations, cost limits and data boundary moves you over between runs, after automated checks. A run keeps the version it started with. **Pin a version.** A pinned pack never changes version. If a pinned version is withdrawn for security, the pack pauses and you choose to move to a safe version. We never move you silently. **Try early versions.** Opt in per pack to get new versions before they become stable. **Anything that asks for more.** A version that needs new access, new destinations, higher costs or a different data boundary waits for your approval in the browser. **When something goes wrong.** We may pause a version and move everyone back to the last good one. We tell you when that happens. **Your results don’t change.** Updates never rewrite results or files you already have. **Who makes versions.** The creator, or the Modpack network’s automatic fixes. Network versions are labeled and pass the same checks. ## 11 · Your inputs, results and export **Yours.** Between you and Modpack, you own your inputs and results. You let us store, process and send them only as needed to run packs for you, keep your account working, keep Modpack secure and follow the law. **Private to you.** Creators never see your inputs, results or files, through diagnostics or anything else. Modpack staff look only when you ask for help or to look into abuse, and every look is logged. **Storage.** Results and files stay while your account is open. The first 5 GB are free. We give 30 days’ notice and an export link before removing anything. **Export.** Export everything in one click, free, anytime: a signed bundle of your results, files, receipts and the pack versions you use. It works with a $0 balance, with paused packs and with no agent connected. The download link lasts 7 days. **Feedback.** If you send us ideas or feedback, we can use them without owing you anything. ## 12 · Acceptable use Use Modpack lawfully and fairly. Don’t use it, or a pack, to: - break the law, or help someone else break it; - infringe anyone’s copyright, trademark, privacy or other rights; - scan, crawl, test or load sites, accounts or systems you don’t own or aren’t allowed to test; - get around CAPTCHAs, logins, paywalls or rate limits on other people’s services; - build or spread malware, or mine cryptocurrency; - get around the sandbox, network rules, spend limits, checks or fraud controls; - write pack text that gives orders to people’s AI agents, or hide instructions in text, files or results; - collect other people’s personal data without a lawful reason, or put sensitive personal data, such as government ID numbers, financial account numbers or health records, into runs; - re-identify anyone from de-identified data; - create or share child sexual abuse material or intimate images of someone without their consent, or harass, threaten or promote violence against people; - send spam, or mislead people about who you are or who made a pack; - open extra accounts for credit, refer yourself, or manipulate questions, reports or rankings; - resell or share access to your account. Packs that use AI models must also follow those model providers’ usage policies. We report child sexual abuse material to the National Center for Missing & Exploited Children, as the law requires. > **Counsel:** Confirm whether to prohibit sensitive personal data in runs outright (the draft does) or allow it for packs built for it, with extra safeguards. ## 13 · Checks, reports, takedowns and appeals **Automated checks on every version.** Before anyone else can run a version, it goes through nine automated checks: clean rebuild and replay, secrets, malware and dependencies, size and structure, where it connects, resource use, instruction safety, a trial run by a test agent, and license. Most versions pass in about 2 minutes. No person reviews a pack before it’s shared, and checks can’t catch everything. **Pass, hold or block.** A blocked version doesn’t go out. A held version works only for its creator while a second automated review runs; if it’s still unresolved, a person decides, usually within 24 hours. **After publishing.** A report, a failed re-check, or unusual failures, network use or spending can pause new adds of a version. Two independent reports or a failed re-check pause it for everyone and move people back to the last good version. We tell the people affected. Past results don’t change. **Reporting a pack.** Use Report on the pack’s page, or ask your agent to report it. A person reads every report and emails you the outcome, usually within 24 hours. The creator never learns who reported. **What we can do.** Remove content, pause or remove a pack, limit what a creator can publish, or suspend an account that breaks these terms or puts people at risk. When we act, we say why, unless the law or someone’s safety prevents it. **Appeals.** Creators appeal a pause, hold, takedown or account action from the Studio. Anyone else can reply to our notice or email [legal@modpack.md](mailto:legal@modpack.md). A person who didn’t make the first decision reviews it, usually within 24 hours. ### Copyright and intimate-image notices **Copyright notices.** If you believe a pack infringes your copyright, send our designated agent a notice with: your physical or electronic signature; the work you say is infringed; the material and where it is on Modpack (a link is best); your contact details; a statement that you believe in good faith the use isn’t authorized; and a statement, under penalty of perjury, that the notice is accurate and you’re authorized to act for the owner (17 U.S.C. § 512(c)(3)). You can also start a notice from Report on the pack’s page. **What we do with a notice.** We act on valid notices within 48 hours: we disable the material and tell the creator how to respond. People who added the pack keep their past results. **Counter-notices.** A creator who believes the removal was a mistake can send a counter-notice from the Studio, signed under penalty of perjury (17 U.S.C. § 512(g)(3)). We forward it to the person who sent the notice. The material comes back in 10 to 14 business days unless they tell us they’ve gone to court. **Repeat infringers.** We close the accounts of repeat infringers. By default that’s three upheld notices within 12 months. **Intimate images.** We remove intimate images shared without consent within 48 hours of a valid request, under the TAKE IT DOWN Act. **Designated agent.** Copyright Agent, Modpack, Inc., \[postal address to be added\], [legal@modpack.md](mailto:legal@modpack.md). > **Counsel:** Before launch (plan §12.9, M1 entry): register the DMCA designated agent with the U.S. Copyright Office and add its postal address, confirm the repeat-infringer threshold (draft: 3 upheld notices in 12 months), and complete NCMEC CyberTipline registration. ## 14 · If you publish packs: creator terms in brief Creators accept the [Creator Agreement](https://modpack.egoeimi.org/creators/agreement) on their first-time creator page. It’s a separate document, and it governs where it differs from this summary. Its key terms, as shown on that page: > Creator Agreement v1: you own your packs; Modpack hosts and runs them for the people you share them with, under a royalty license. You set the price, $0 to $5 a run that works, and keep 80% (founding creators 90% for 24 months). Earnings are pending for 30 days, paid monthly on the 15th from $25, and never forfeited. Stripe checks your identity and tax ID once, before the first payout. No income claims in listings and no charging people outside Modpack. You handle your income taxes; Modpack handles sales tax. > > Creator Agreement v1 · key terms **License to Modpack.** You keep ownership of your packs and license them to Modpack to host, run, check, display and sell runs of, in exchange for a royalty. Modpack sells every run; you aren’t the seller. **Open license and network versions.** Public packs use an allowed open license: Apache-2.0 by default, or MIT, BSD, ISC, 0BSD, CC0, or CC BY 4.0 for text-only packs. You also let Modpack build and distribute improved versions made by the Modpack network, labeled as such, with your credit kept. **Price.** $0 to $5 per run that worked, set by you or your agent. Decreases apply at once. Increases apply 14 days after notice, at most once every 30 days. Runs already set aside keep their price. **Your share.** 80% of your price; founding creators keep 90% for 24 months. Usage is billed separately to the person running the pack. Running your own pack costs usage only. **Earnings.** Pending for 30 days, then available. Runs paid with promotional credit become available only once that person’s paid credit has cleared: 60 days after a paid top-up with no refund or chargeback, and never more than the cleared amount. A run that doesn’t work isn’t charged and earns nothing. **Payouts.** Monthly on the 15th when $25 or more is available, plus a December payout from $5, through Stripe Connect Express, net of payout fees. Stripe checks your identity and tax ID once, before the first payout; earnings keep adding up meanwhile. **Refunds and chargebacks.** Refunds and chargebacks on runs you earned from come out of your future earnings for 180 days. Your balance never goes negative, and we never chase you for a debt. **Never forfeited.** Unpaid earnings are never forfeited. If we can’t pay you, they follow unclaimed property law. **Taxes.** You handle your income taxes. We issue a 1099-MISC for royalties of $10 or more in a year. Modpack handles sales tax on runs. **What you can’t do.** Ask people to pay you outside Modpack for runs of your pack; make income claims in listings; or post about Modpack without disclosing the credit or other perks you get from us. **Your promises.** You have the rights to everything in your pack, its description is accurate, and it follows these terms. You never try to identify the people who run it or reach their data; you see totals across 5 or more people only. **Authoring credit.** New creators get a one-time $25 promotional credit for builds and test runs. **New creators.** New creators start with limits on what packs can do, such as using people’s connected accounts or running local steps. They lift after 14 days with a passkey, a verified payment method, checked results from 5 independent people and no upheld reports. **Earnings projections.** Any projection we show is hypothetical, based on the numbers you enter. It isn’t a prediction or a promise. > **Counsel:** The full Creator Agreement is a separate document for counsel to finalize, including the Network Revisions License, creator warranties and indemnity (plan §19.9, Q-07, Q-12). Its page, /creators/agreement, is the URL seeded for creator\_agreement v1. ## 15 · Closing your account, and ours **You can leave anytime.** Delete your account from [Settings](https://modpack.egoeimi.org/account/delete). You confirm with a passkey or by signing in again, and you can cancel for 24 hours. Your agent can’t delete your account for you. **What happens.** Your agent loses access and your packs are removed right away. Files, results and connections are deleted within 7 days, and backups expire within 30 days. Receipts are kept as the law requires, with only your name, dates and amounts. Unspent paid credit is refunded to your card within 10 days; promotional credit ends with the account. **When we can suspend or close.** We can suspend or close an account that breaks these terms, puts people or Modpack at risk, or that the law requires us to close. Where we can, we warn you first and give you time to export. You can appeal (section 13). **If we stop offering Modpack.** We give at least 30 days’ notice, keep export working and refund unspent paid credit. **What continues.** Terms that by their nature should outlast the account still apply, including the contribution license for material already contributed, amounts owed, and sections 16 and 17. ## 16 · Warranty and liability > **Counsel:** Draft placeholders. The plan recommends as-is terms for third-party packs, a liability cap, a lost-data exclusion, and creator warranties and indemnity (plan Q-12). Counsel to write the final text of this section. **As is.** \[Draft\] Modpack and packs are provided “as is” and “as available”. As far as the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that a pack or result is accurate, complete or right for your purpose. **Third-party packs.** \[Draft\] Most packs are made by independent creators. Our checks reduce risk but don’t make us responsible for a creator’s content. **Limit of liability.** \[Draft\] As far as the law allows, neither side is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data. Our total liability for all claims is limited to the greater of what you paid Modpack in the 12 months before the claim, or $100. **Your responsibility.** \[Draft\] You’ll cover claims against Modpack that come from your breach of these terms or your unlawful use of Modpack. Creators make broader promises in the Creator Agreement. **Rights the law keeps.** Nothing here limits rights you have by law that can’t be waived. ## 17 · Governing law and disputes **Talk to us first.** If something goes wrong, email [legal@modpack.md](mailto:legal@modpack.md). We’ll try to resolve it within 30 days before either side goes to court. **Governing law.** \[Placeholder\] The laws of the State of Florida and applicable US federal law govern these terms, without regard to conflict-of-law rules. **Where.** \[Placeholder\] The state courts in \[county\], Florida, or the federal court for that district. Either side can use small claims court where a claim qualifies. > **Counsel:** Choose governing law and venue (draft: Florida, the founder’s home state, plan §3.4), and decide on arbitration with a class-action waiver and a small-claims carve-out, which the plan recommends (Q-12). This draft has no arbitration clause until counsel writes one. ## 18 · Changes to these terms **Notice.** We post every version here with its date. Before a material change applies, we tell you by email and in your account, at least 14 days ahead unless the law or a security issue needs a faster change. **Material changes need your agreement.** A material change applies to you only after you agree to it. Until then new runs wait, and everything else keeps working: files, results, receipts and export. **Learning changes are never retroactive.** A change to how we use your runs for learning needs your fresh, affirmative agreement and never applies to runs from before you agreed. **Small changes.** Changes that don’t reduce your rights, such as clearer wording, apply when posted. > **Counsel:** Confirm that pausing new runs until a person accepts a material change is acceptable, and the 14-day notice default. ## 19 · Contact and legal notices **Legal and copyright.** [legal@modpack.md](mailto:legal@modpack.md) **Privacy.** [privacy@modpack.md](mailto:privacy@modpack.md) **Security issues.** [security@modpack.md](mailto:security@modpack.md). If one part can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver. You can’t transfer this agreement; we can transfer it to a company that takes over Modpack, and we’ll tell you. It’s the Privacy Policy you agree to when you connect Modpack. It covers modpack.md, the Modpack connection in your AI agent, our emails, and every pack you run. Modpack is a US-only beta for people 18 or older. We process and store data in the United States. Your agent’s maker, such as Anthropic for Claude, handles your chats under its own privacy policy. Modpack receives only what your agent sends to a run, never your other chats or memory. Pack creators don’t receive your personal data (section 06). ## 02 · What we collect We sort data into classes. The [contribution license](https://modpack.egoeimi.org/terms#contribution) in the Terms covers the rights; this is what it means for your data. **Where it happens.** Evidence is derived inside your account’s boundary. When an AI model helps classify it, that call runs for your account under our commercial agreements with US-hosted AI providers. It isn’t public learning. **What can leave your account.** Only de-identified, minimized evidence: outcomes, error and failure types, timings, resource use, which checks passed, which fix worked, and general patterns. Never your files, inputs or results, data from your connected accounts, credentials, raw logs, or anything that identifies you or another person. **How.** Fixed fields instead of free text, rounded values, synthetic test cases instead of your inputs, checks that no text from your inputs slips through, and a minimum of 5 accounts behind any metric. Dates in metrics are rounded to the week and never come with file names or which runs a fix came from. Anything unclear is held back and deleted after 7 days. **Who it reaches.** The learning audience: the pack’s creator, who sees totals across 5 or more people (below that, “not enough data yet”), and the Modpack network, as improved pack versions everyone can use. **Our commitment.** We keep de-identified information in de-identified form and don’t attempt to re-identify it. Everyone who receives it, including creators and other users, is bound by contract not to re-identify it either. **Stopping.** Stop anytime in [Settings](https://modpack.egoeimi.org/account/withdraw). New evidence stops being eligible at once, and your packs pause, because learning is part of how managed packs work. Export, files, receipts and every right in section 09 keep working. What was already built into released versions stays there; it was never linked to you. **Changes.** We ask for your fresh agreement before using your runs for learning in a materially different way. A change never applies to runs from before you agreed. > **Counsel:** Confirm that the three de-identification conditions (technical measures, this public commitment, and the contractual ban in the Terms) meet CCPA §1798.140(m) and Connecticut’s definition, so contribution isn’t a “sale” (plan §12.7, Q-09). ## 05 · No selling, no ads, no AI training **We don’t sell personal data.** We don’t sell your personal data, and we don’t “share” it for cross-context behavioral advertising, in the sense California law uses. **No ad trackers.** There are no advertising or social media trackers on Modpack. **No AI training on your data.** We don’t train foundation models or any other AI models on your data, and our AI providers’ commercial terms don’t let them train on it. Learning improves packs, meaning their code, instructions and checks, not AI models. **Opt-out signals.** Because we don’t sell or share, there’s nothing to opt out of. We still honor Global Privacy Control signals as an opt-out request. > **Counsel:** Confirm the current API terms of each AI provider (no training on API data, retention periods, zero-retention options) before first use (plan §7.7, §12.7). ## 06 · Who we share it with **Service providers.** Companies that host, run and support Modpack for us, under contracts that limit their use of your data to that work. They’re listed below, and we add a provider here before we use it. **Pack creators.** Never your personal data, inputs, results or files. Creators see totals across 5 or more people (runs, how often runs worked, failure types) and the text of questions asked on their pack page, without names. When you report a pack, the creator never learns who reported it. **Your agent.** Results go to the agent you connected, because you asked for them. **Legal requests.** When the law requires it, such as a valid subpoena or court order. We tell you first unless the law or an emergency prevents it. We report child sexual abuse material to NCMEC as the law requires. **If Modpack changes hands.** If Modpack is merged or sold, your data goes to the new owner, bound by this notice. Our databases and files are in Google Cloud’s us-east4 region (Virginia), and packs run in Vercel sandboxes in iad1 (Washington, D.C. area). During the beta we use only US-hosted providers, and we don’t transfer personal data outside the US. Most take one click in your account. **See what we hold.** “What we hold” in [Settings](https://modpack.egoeimi.org/account/settings) lists the data in your account, your consent records and where each is kept. **Export.** Download everything as one signed bundle from [Export](https://modpack.egoeimi.org/account/export). It’s free and works with a $0 balance, with paused packs and with no agent connected. We email you when it’s ready. **Delete.** Delete your account from [Settings](https://modpack.egoeimi.org/account/delete), confirmed with a passkey or by signing in again. You can cancel for 24 hours. Your data is deleted within 7 days and backups expire within 30 days. Receipts stay as the law requires. **Stop learning from your runs.** From [Settings](https://modpack.egoeimi.org/account/withdraw). Your packs pause; export and your other rights keep working. **Correct.** Change your name and email in Settings, or ask us to fix anything else. **Disconnect.** Revoke an agent or a connected account anytime in [Connections](https://modpack.egoeimi.org/account/connections). **Email choices.** Turn off optional email in Settings. Email about your runs, money and security stays on while your account is open. **Asking us.** Email [privacy@modpack.md](mailto:privacy@modpack.md). We confirm it’s you by asking you to sign in, and answer within 30 days, or 45 at most if we tell you why we need longer. **Someone acting for you.** An authorized agent can ask for you with your signed permission. We still confirm your identity with you. **If we say no.** Reply to our answer to appeal. A different person reviews it and answers within 45 days. If you’re still unhappy, you can contact your state attorney general. **No penalty.** We don’t charge you more or treat you worse for using these rights. Stopping learning pauses managed runs because learning is part of how they work; everything else, including export, keeps working. > **Counsel:** Response and appeal times follow the common state-law pattern (45 days to answer; appeals answered within 45 to 60 days). Confirm them together with open question 1 in plan §12.7 (mandatory contribution and anti-waiver rules). ## 10 · Children Modpack is for adults. You must be 18 or older, and everyone confirms it when they connect. Nothing on Modpack is aimed at children. If we learn an account belongs to someone under 18, we close it and delete its data. If you think a child has an account, email [privacy@modpack.md](mailto:privacy@modpack.md). ## 11 · How we protect it - Every run gets a fresh sandbox of its own, deleted after the run. Pack code never runs on your computer. - Sandboxes reach only the sites a pack declared, through our network proxy, and hold no secrets. Every connection is logged. - Tokens for accounts you connect stay in our vault and are added only at the network edge. Packs never see them. - Only signed pack versions run, and the signature is checked before each run. - Data is encrypted in transit and at rest. - Staff access is limited, needs strong sign-in and is logged. No system is perfectly secure. If a breach affects your personal data, we tell you within 30 days and tell regulators as the law requires. Report a security issue to [security@modpack.md](mailto:security@modpack.md); we reply within 1 business day. We receive whether its checks passed, your payout status and what we need to file your 1099-MISC, and keep tax records as the law requires. **What you see about people who run your packs.** Totals across 5 or more people, and question text without names. Never their identity, inputs, results or files. **Counter-notices.** If you send a copyright counter-notice, we forward your name, address, phone number and statement to the person who sent the notice, as the law requires. ## 14 · Changes to this notice We post every version here with its date. Before a material change applies, we tell you by email and in your account, and ask for your agreement. (“Modpack”, “we”, “us”) and covers publishing packs on Modpack. It adds to the [Terms](https://modpack.egoeimi.org/terms), which apply to creators too. Where the two differ on a creator topic, such as price, earnings or licenses, this agreement wins. Its key terms, exactly as shown on the creator setup page: > Creator Agreement v1: you own your packs; Modpack hosts and runs them for the people you share them with, under a royalty license. You set the price, $0 to $5 a run that works, and keep 80% (founding creators 90% for 24 months). Earnings are pending for 30 days, paid monthly on the 15th from $25, and never forfeited. Stripe checks your identity and tax ID once, before the first payout. No income claims in listings and no charging people outside Modpack. Only you can accept it: Claude Code opens the page, but it can’t sign you in or accept an agreement for you. > **Counsel:** Confirm the legal entity and whether founding creators also sign the one-page Founding Creator Agreement (plan WP-A01, adapted from Common Paper’s Design Partner Agreement). This draft assumes that document only adds program terms and never lowers anything here. ## 02 · Who can be a creator **US residents, 18 or older.** Creators must live in the United States and be 18 or older, like everyone on Modpack. We screen creators against US sanctions lists before paying anyone. **One creator account per person.** Your creator account is your handle, such as modpack.md/yourname. You can change the handle once in the first 30 days. Handles can’t impersonate a person, brand or Modpack, and some names are reserved. **Your sign-in.** Keep your sign-in secure. Some steps need your passkey or a fresh sign-in, because they change what other people get: sharing a pack for the first time, or changing its license, visibility or update authority. ## 03 · Your packs, and the license you give Modpack **You own your packs.** You keep ownership of your packs: their code, instructions, checks, examples and listing. Nothing here transfers ownership to Modpack. **The royalty license.** You give Modpack a non-exclusive, royalty-bearing license to host, store, copy, build, run, test, check, display and distribute your packs, and to sell runs of them, to the people you share them with. The royalty is your share of your price (section 08). The license covers each version while it’s available on Modpack. **Modpack sells every run.** People buy runs from Modpack, not from you, and Modpack pays you a royalty. You aren’t a seller on a marketplace, and Modpack doesn’t hold money for you as an agent. **An open license for shared packs.** A pack you share uses an allowed open license: Apache-2.0 by default, or MIT, BSD-2-Clause, BSD-3-Clause, ISC, 0BSD or CC0, and CC BY 4.0 for text-only packs. Copyleft, non-commercial, no-derivatives and source-available licenses (such as GPL, AGPL, LGPL, MPL, CC BY-SA, BSL and SSPL) aren’t accepted. **People who add your pack.** People who add your pack can export the version they use, under its license, and keep their results. A version already released can’t be recalled from people who have it. **Your promises about content.** You have the rights to everything in your pack, its declared license is accurate, and it keeps third-party notices. It contains no secrets, no one else’s confidential material, and nothing a client or employer hasn’t allowed you to share. **Our listing and discovery.** We can show your pack’s name, description, price, evidence and your handle on Modpack, in search, in the Markdown and llms.txt pages AI assistants read, and when we tell people about Modpack. > **Counsel:** Confirm the scope and term of the royalty license (draft: non-exclusive, per version, while available on Modpack) and how it sits beside the open license, which already lets anyone redistribute a shared pack (plan §19.9, Q-07). ## 04 · Network improvements and update authority When your pack fails or struggles in real runs, the Modpack network can repair it: it proposes a change, tests it against the same checks as your versions, and releases it as a labeled network version. Your update authority decides which of those changes go out without asking you. | Kind of change | Default | You can choose | | --- | --- | --- | | Fixes | Ship after tests | Ship after tests, or ask you | | Cheaper or faster steps | Ship after tests | Ship after tests, or ask you | | New libraries | Within policy: allowed licenses, pinned and scanned | Within policy, or ask you | | More access, new destinations or higher costs | Always asks each person who added the pack | Ask each person, or never | | Billing, consents, checks and security | Never changed | Never changed | **Choosing it.** You choose update authority when you first share a pack, and can change it later with your passkey. “Creator only” makes every network change wait for you. **Network Revisions License.** You give Modpack a perpetual, sublicensable license to make, release and distribute network versions of your pack. Every network version keeps your notices and credit, is labeled “modified by the Modpack network”, and comes with a changelog. As far as the law allows, you waive moral rights that would block these changes. **Your new versions.** When you publish a new version, it goes out first, and network fixes are re-applied on top of it only after they pass the checks again. **Who is responsible.** Modpack is responsible for the changes its network makes. You’re responsible for your own content. **Your price applies.** Your price and share apply to every version of your pack, including network versions. > **Counsel:** Review the Network Revisions License (perpetual, sublicensable, credit and label kept, moral-rights waiver; plan Q-07) and Modpack taking responsibility for network versions, which the plan treats as Modpack’s own product rather than third-party content (Q-12). ## 05 · Publishing, automated checks and listing rules **Your agent does the work.** Your agent, such as Claude Code, can package your setup, draft the listing, publish new versions under unchanged terms and set your price. Only you can accept this agreement, confirm a pack’s first share, change its license, visibility or update authority, retire it, set up payouts or sign a counter-notice. **Automated checks on every version.** Every version goes through nine automated checks before anyone else can run it: clean rebuild and replay, secrets, malware and dependencies, size and structure, where it connects, resource use, instruction safety, a trial run by a test agent, and license. Most versions pass in about 2 minutes. Modpack pays for the checks. **Pass, hold or block.** A blocked version doesn’t go out, and your agent gets the exact file, line or destination with a suggested fix. A held version keeps working privately for you: a second automated review runs, your agent can fix or declare the behavior, and if it’s still unresolved a person decides, usually within 24 hours. **Declared actions.** If your pack asks the person’s agent to do something, such as run the project’s own tests, you declare it. Declared actions are shown on the pack page and checked against the declaration. **An accurate listing.** Describe what the pack does, what it’s for and not for, and its limits, accurately. Evidence labels and success rates are computed by Modpack from real runs; you can’t edit them. **Pack text.** Pack text can give the person tips, never orders to their AI: no instructions to visit sites and obey what they say, run commands, call other tools or connectors, or ignore earlier instructions; no hidden or encoded text; no promotion aimed at the AI. **Packs that visit sites.** Use an honest user agent, respect robots.txt, keep to rate limits, and stop on a login wall, 401, 403, 429 or CAPTCHA. No CAPTCHA solving and no proxies to get around blocks. A full crawl needs the person to verify the domain. Reports never claim that a site complies with a law or standard. **Your own costs.** New creators get a one-time $25 promotional authoring credit for builds and test runs. After that, builds, test runs and your own runs of your packs are charged at the rate card, with no creator price and no royalty on your own runs. ## 06 · Trust levels | Level | How you get there | What it means | | --- | --- | --- | | New | A verified account: passkey or social sign-in, US and 18+ confirmed, sanctions screening passed. | Private and unlisted packs, labeled “New creator · automated checks”. No audience or volume caps. No packs that use people’s connected accounts, run local steps, or reach beyond the run’s targets and declared hosts, and at most the standard resource profile. | | Established | At least 14 days old, a passkey, a verified payment method, checked results from 5 independent people, and no upheld reports. Founding creators start here. | Public listing and all capabilities, each still checked on every version. | | Restricted | An upheld report or a quarantine. | Sharing is suspended. You can appeal (section 12). | Instead of caps, signals pause new adds of a version: a report, a failed re-check, a spike in failures, or unusual network use or spending. Popular packs are re-checked at 100, 1,000 and 10,000 people, and people review a random sample of new versions. ## 07 · The people who run your packs **You never see their data.** You never see the identity, inputs, results or files of the people who run your pack, through diagnostics or any other way. **What you do see.** Totals across 5 or more people: runs, how often runs worked, and failure types, with dates rounded to the week. Below 5 people you see “not enough data yet”. Questions asked on your pack page, without names. You never learn who reported your pack. **Don’t try.** Don’t try to identify people, re-identify anyone from de-identified data, collect their data through your pack, or contact them outside Modpack about their runs. Packs reach only the hosts they declare, and every connection is logged. **No charging outside Modpack.** Don’t ask people to pay you outside Modpack for runs of your pack, and don’t move them off Modpack to avoid its price. > **Counsel:** Confirm the reach of “no charging outside Modpack”: the draft covers runs of the pack only, not a creator’s other products, courses or consulting. ## 08 · Your price and your share **Your price.** $0 to $5 per run that worked, per pack or per entrypoint, set by you in the Studio or by your agent. $0 means free. People pay usage at the rate card plus your price, and see both before a run starts; your price is its own line on every receipt. **Charged only when it works.** Your price is charged only on runs that worked. A run that doesn’t work, or that the person stops, isn’t charged your price and earns you nothing. **Changing it.** Decreases apply right away. Increases apply 14 days after notice, at most once every 30 days. Runs already set aside keep their price, and people with auto top-up are told before a new price applies. **Your share.** You keep 80% of your price. Founding creators keep 90% for 24 months from when they set up their creator account, then 80%. Modpack keeps the rest of your price, and the usage margin, to run the service. **An example.** At a price of $0.50, the person pays usage plus $0.50. You earn $0.40, or $0.45 as a founding creator. Modpack keeps $0.10, or $0.05. ## 09 · Earnings and payouts **Pending, then available.** Each run that worked adds your share to pending earnings. They become available after 30 days, which covers refunds and fraud checks. **Runs paid with free credit.** Runs paid with starter or other promotional credit still earn, but those earnings become available only once that person’s paid credit has cleared: 60 days after a paid top-up with no refund or chargeback, and never more than the cleared amount. **Payouts.** Monthly on the 15th, when $25 or more is available, plus a December payout from $5. Paid to your bank through Stripe Connect Express. Stripe’s payout fees, today $2 for each month you’re paid plus 0.25% + $0.25 per payout, come out of the payout. **Identity and tax ID first.** Stripe checks your identity and tax ID once, before the first payout. Until then, earnings keep adding up. **Refunds and chargebacks.** Refunds and chargebacks on runs you earned from come out of your future earnings for 180 days. Your balance never goes negative, and we never chase you for a debt. **Never forfeited.** Earnings are never forfeited and carry no fees for being unpaid. If we can’t pay you, we contact you, and after the dormancy period the law sets (5 years in Florida) we report them as unclaimed property. **Statements.** The Studio shows pending, available and paid earnings, each payout, and any refund taken from earnings. **Projections.** An earnings projection answers “if I set this price, what would I earn at this many runs?”. It starts empty, uses only the numbers you enter, and is net of payout fees and before income tax. It’s labeled “Hypothetical, based on the numbers you entered. Not a prediction or a promise.” Typical results appear only after 90 days and 20 or more priced packs, as medians. > **Counsel:** Confirm that creators bear Stripe’s payout fees (the plan shows projections net of them, §19.9) and the unclaimed-property handling of unpaid earnings (Florida 5-year dormancy, due-diligence notices, report by May 1). ## 10 · Taxes **Income tax is yours.** You handle your own income taxes on what you earn. **1099-MISC.** We report royalties of $10 or more in a year on Form 1099-MISC (box 2), filed and delivered electronically through Stripe. Corporations are generally exempt. **Sales tax is ours.** Modpack collects and pays sales tax where it applies. Your price is part of Modpack’s sale, so you don’t register or collect sales tax for runs of your pack. > **Counsel:** Confirm the royalty characterization and 1099-MISC box 2 reporting at the $10 threshold (plan §19.9, research medium-high confidence). ## 11 · Promotion, earnings claims and disclosures **No income claims.** Don’t make claims about what anyone can earn from Modpack in listings, pack pages or outreach, and don’t invent example creators or results. Modpack doesn’t make earnings claims either. **Disclose what you get.** When you post about Modpack or your pack, say so in the post itself if you get anything from us: credit, a better share, early access, featuring or referral rewards. With a referral link, say “I earn Modpack credits if you join via my link”. **Reviews and questions.** Never buy, reward or fake reviews, questions or reports, and never tie a perk to someone saying something positive. **If a post needs fixing.** We may ask you to fix a post that breaks these rules. Perks we give never depend on positive things you say about Modpack. ## 12 · Reports, takedowns and appeals **When a version is paused.** One report pauses new adds of that version while it’s re-checked. Two independent reports or a failed re-check pause it for everyone and move people back to the last good version, which keeps running and earning as usual. Your agent gets the exact line to fix, and the fixed version goes out after checks. **Appeals.** Appeal a pause, hold, takedown or trust change from the Studio. A person who didn’t make the first decision reviews it, usually within 24 hours. Your fix can go out meanwhile. **Copyright notices.** We act on valid copyright notices within 48 hours by disabling the material, and send you the notice. People who added the pack keep their past results; new runs pause. The fastest way back is usually to remove the material and republish. **Counter-notices.** If you wrote it, you can send a counter-notice from the Studio. It’s a sworn statement, so only you can sign it. We forward it the same day, and the pack comes back in 10 to 14 business days unless the sender tells us they’ve gone to court. **Repeat infringers and removed slugs.** We close the creator accounts of repeat infringers, by default after three upheld notices within 12 months. A pack’s address stays reserved after a takedown, so nobody else can take it. ## 13 · Claiming a “Built by Modpack” pack Some packs are built by Modpack from open-source projects and labeled “Built by Modpack on {project} ({license})”. A maintainer of one of those projects can claim the pack. Claiming it means accepting this agreement. **Who can claim.** An admin of an upstream repository the pack is built on. You prove it by signing in with GitHub (write access isn’t enough; we don’t keep the token) or by committing a `.modpack/claim` file to the default branch. **What you get.** The pack’s dashboards, as totals across people; a veto on its listing, meaning you can edit its title, description and limits or ask us to remove it, and we act within 7 days; and the creator share of any price you set. **What stays the same.** Your repository, its license and its notices don’t change. Modpack keeps the pack working, carries upstream notices, credits the project on the page and on every receipt, and sends fixes upstream. **Disputes.** If another admin already claimed it, ask them to add you. If a claim is wrong, a person reviews it within 7 days. ## 14 · Retiring packs, leaving, and what people keep **Delist.** Delisting takes a pack out of Browse and search. People who added it keep it. **Retire.** Retiring a pack gives the people who added it 30 days’ notice, and then it stops running. You can point them to a replacement and undo it until the date. Their results, files and exports stay with them. **Leaving.** You can close your creator account anytime. Your packs are retired the same way, with 30 days’ notice to the people who use them. Pending earnings become available on schedule, and we pay what’s available at the next payout, even under $25. **When Modpack ends it.** We can suspend sharing, remove packs or close a creator account that breaks this agreement or the Terms, or puts people at risk, with a reason and a way to appeal. Earnings from fraudulent or invalid runs aren’t earned. Everything else you earned is still paid. For any other reason, we give 30 days’ notice. **What continues.** The open license and the Network Revisions License for versions already released, people’s rights to what they already have, and our duty to pay your earnings all outlast the agreement. > **Counsel:** Confirm the defaults for leaving: packs retire with 30 days’ notice (the code’s deprecation period), available earnings are paid even under the $25 minimum, and earnings from fraudulent runs are reversed rather than forfeited. ## 15 · Warranties, indemnity and liability > **Counsel:** Draft placeholders. The plan calls for creator warranties and indemnity, a liability cap and as-is terms (Q-12). Counsel to write the final text of this section. **Your warranties.** \[Draft\] You promise that you have the rights described in section 03, your pack and listing are accurate, your pack contains no malware or hidden instructions, and you follow the law and this agreement. **Your indemnity.** \[Draft\] You’ll cover claims against Modpack that come from your pack’s content, your listing, or your breach of this agreement, except where the claim comes from a change the Modpack network made. **As is.** \[Draft\] Modpack provides the service, checks, projections and payouts “as is”. Checks reduce risk but don’t guarantee a pack is safe or useful, and we don’t promise any level of runs or earnings. **Limit of liability.** \[Draft\] As far as the law allows, neither side is liable for indirect or consequential damages or lost profits. Our total liability is limited to the greater of what we paid you in the 12 months before the claim, or $100. This never limits our duty to pay earnings you’ve earned. ## 16 · Changes, law and general terms **Changes.** We tell you at least 30 days before a material change, by email and in the Studio, and it applies once you accept it. A change to your share or payout terms never applies to earnings you’ve already made. **Independent.** You’re an independent creator, not Modpack’s employee, agent or partner. You don’t pay anything to earn: no paid plan is needed. **Governing law.** \[Placeholder\] Florida law and applicable US federal law, with disputes handled as the Terms set out. **The rest.** This agreement and the Terms are the whole agreement about publishing on Modpack. If one part can’t be enforced, the rest still applies.
